General Terms and Conditions (GTC) of Lux Resilience Sàrl-S
1. Scope of Application
These General Terms and Conditions (GTC) apply to all business relationships between Lux Resilience Sàrl-S (hereinafter referred to as "Lux Resilience"), its customers, and users of the website. By using the website or purchasing products and services, you agree to these GTC. Lux Resilience reserves the right to change these GTC at any time. The current version is available on the website.
2. Company
Lux Resilience is a company specializing in the design, manufacture, and sale of tactical clothing and equipment. Additionally, the company offers first aid training for adults and newborns, training in managing severe bleeding in the civilian sector, and TECC (Tactical Emergency Casualty Care).
3. Products
Lux Resilience offers a wide range of products, including tactical clothing, safety equipment, and specialized pants. Our products are designed for use in demanding environments. All products displayed on the website may be changed in design and specifications without prior notice.
4. Services
In addition to physical products, Lux Resilience offers the following services:

First Aid courses for adults and newborns: training in life-saving immediate assistance for emergencies and safety management for newborns.

Bleeding management in the civilian sector: training focused on preventing severe blood loss through tourniquets and other techniques.

TECC courses : training specifically for emergency situations.
5. Use of Tactical Equipment
The tactical equipment from Lux Resilience is designed for use in demanding environments and scenarios. However, the use of this equipment is at the customer's own risk. Due to the nature and intended use conditions of the products, Lux Resilience does not guarantee a specific result or success in use. No liability is assumed for the failure to achieve desired or expected results, as this depends on a variety of external factors beyond Lux Resilience's control.
6. Contract Conclusion
A contract between the customer and Lux Resilience is concluded by the customer’s order and subsequent confirmation by Lux Resilience via email or in writing. The confirmation includes the details of the order, including the products or services ordered, the prices, and the estimated delivery or execution times.
7. Prices and Payment Terms
All prices listed on the website are in the specified currency and include, unless otherwise stated, the applicable VAT. Shipping costs are listed separately and shown in the order summary before completing the purchase.
Payment can be made via the payment methods offered on the website. Delivery will only occur once full payment has been received. Lux Resilience reserves the right to reject orders or withhold delivery if the customer fails to meet their payment obligations.
8. Delivery and Shipping
Delivery is made to the address specified by the customer. Delivery dates are non-binding unless explicitly agreed upon in writing. Lux Resilience is not liable for delays caused by force majeure or external factors.
The customer is obliged to inspect the delivered goods immediately upon receipt for completeness and any defects and to immediatly report any issues.
9. Right of Withdrawal and Returns
Consumers have a right of withdrawal for 14 days from receipt of the goods. The withdrawal must be declared in writing or via email. Return shipping costs are to be borne by the customer, provided the goods correspond to the order and are free of defects.
Exceptions:

Medical products, on which a person's life may depend, are excluded from the right of withdrawal if materials have been unpacked from the protective plastic.

Hygienic products (such as socks), can be returned unworn and unused. A detached label with removed plastic ties is considered a used product.

Products that have been manufactured to individual customer specifications are excluded from the right of withdrawal.
10. Liability
Lux Resilience is liable for damages caused by intentional or grossly negligent breaches of duty. For minor negligence, Lux Resilience is only liable for the violation of essential contractual obligations and limited to typical, foreseeable damages. No liability is assumed for indirect damages, particularly loss of profits or data loss.
11. Warranty
The warranty is governed by the statutory provisions. In case of defects, the customer has the choice between rectification or replacement. Lux Resilience may refuse the chosen form of rectification if it causes disproportionate costs.
12. Training and Courses
Registrations for courses are binding. If a course is canceled up to 7 days before the start, a processing fee of 25% of the course fee will be charged. If the cancellation occurs later, the full course fee is due.
Lux Resilience reserves the right to cancel courses due to unforeseen circumstances. In this case, the full amount will be refunded. Further claims, particularly for damages, are excluded..
13. Data Protection
Customer data is processed in compliance with applicable data protection laws. Personal data is used solely for processing orders and inquiries and will not be shared with third parties without the customer's express consent.
14. Copyright
All content displayed on the website, particularly logos, texts, images, and graphics, is protected by copyright and other laws protecting intellectual property. Use without explicit permission is prohibited.
15. Applicable Law and Jurisdiction
Lux Resilience Sàrl-S is subject to the laws of the Grand Duchy of Luxembourg. The exclusive place of jurisdiction for any disputes is the location of Lux Resilience Sàrl-S, unless the customer is a merchant or a legal entity under public law.
16. Final Provisions
If any individual provisions of these GTC are wholly or partially invalid, the validity of the remaining provisions will remain unaffected. The invalid provision will be replaced by the regulation that most closely reflects the economic purpose of the invalid provision.
